Standard Weights and Measures (Fourth Amendment) Act, 1988

Preamble Whereas it is expedient to amend the 1968 Standard Weights and Measures Act, now therefore, His Majesty King Birendra Bir Bikram Shah Dev has enacted this law on the advice and with the approval of the National Panchayat. 1. Short Title and Commencement (1) This law may be called the Standard Weights and Measures (Fourth Amendment) Act, 1988. (2) It shall come into force at once. 2. Amendment in Section 3 of the 1968 Standard Weights and Measures Act Section 3 of the 1968 Standard Weights and Measures Act (hereinafter called the principal act) has been amended as follows: 3. Meter (1) The basic unit of length shall be the meter. (2) The term "meter" means the distance covered by light in a vacuum in 1/299792458th of a second. (3) In order to determine the value of the meter, His Majesty's Government shall arrange for the preparation of a national standard and have this standard meter authenticated through verification with the international standard. Such standard shall be kept at the place and in the custody of the person prescribed by His Majesty's Government. 3. Amendment in Section 4 of the Principal Act Section 4 of the principal act has been amended as follows: 4. Kilogram (1) The basic unit of weight shall be the kilogram. (2) In order to determine the value of the kilogram, His Majesty's Government shall arrange for the preparation of a national standard and have this standard kilogram authenticated through verification with the international proto-type or with the national proto-type of a foreign country which has been prepared according to the international proto-type. Such standard shall be kept at the place and in the custody of the person prescribed by His Majesty's Government. (3) Notwithstanding anything contained in Sub-Section (1) and Section 8B, the basic unit of volume in respect to precious stones shall be the carat, that is, the 1/500th part of a kilogram. (4) The standard unit of weight at any place shall be the weight of the volume of the basic unit thereof. 4. Amendment in Section 5 of the Principal Act In Section 5 of the principal act. (1) The Section heading "Unit of Time" has been replaced by "Second". (2) Sub-Section (1) has been amended as follows: (1) The basic unit of time shall be second. 5. Amendment in Section 6 of the Principal Act In Section 6 of the principal act. (1) Section heading "Unit of Electricity" has been replaced by "Ampere". (2) Sub-Section (1) has been amended as follows: (1) The basic unit of electric current shall be the ampere. 6. Amendment in Section 7 of the Principal Act In Section 7 of the principal act, (1) The Section heading, "Measurement of Temperature" has been replaced by "Kelvin". (2) Sub-Section (1) has been amended as follows: (1) The basic unit of thermodynamic temperature shall be the kelvin. 7. Amendment in Section 8 of the Principal Act In Section 8 of the principal act, (1) The Section heading, "Unit of Light", has been replaced by "candela". (2) The unit of luminous intensity shall be the candela. 8. Amendment in Section 8A of the Principal Act Sub-Section (1) of Section 8A of the principal act has been amended as follows: (1) The basic unit of the quantity of any material shall be the mole. 9. Amendment in Section 16 of the Principal Act The words "checked against the national proto-type", occurring in Sub-Section (2) of Section 16 of the principal act, have been replaced by "checked against the national standard". 10. Amendment in Section 26 of the Principal Act Section 26 of the principal act has been amended as follows: 26. License to be obtained No person shall, in the course of his business, manufacture, repair, or sell commercial weighing or measuring machines, or engage in prescribed service enterprises of weighing or measuring, without obtaining a license as prescribed on payment of the prescribed fees from the Inspector. 11. Amendment in Section 36 of the Principal Act Clause (d) of Sub-Section (2) of Section 36 of the principal act has been amended as follows: (d) The procedure to be observed while issuing licenses to manufacture, repair or sell commercial weights or measures, or weighing or measuring machines, or to provide weighing and measuring services, and the terms and conditions to be complied with by the licensee.
